Welcome to Coya's Creations! We are a small Australian business based in New South Wales, specialising in 3D-printed toys, fidgets, collectibles, accessories and personalised creations.

By accessing our website or purchasing our products, you agree to the following Terms of Service.

These Terms are governed by Australian law, including the Australian Consumer Law (ACL). Nothing in these Terms excludes or limits rights that cannot legally be excluded.

1. General Conditions

Coya's Creations ("we", "us", "our") operates the website https://coyascreations.com.au, powered by Shopify.

By using our website, you agree to:

  • Provide accurate information when placing orders.

  • Use our website for lawful purposes.

  • Respect our intellectual property and that of third parties.

  • Refrain from fraudulent activity or interference with our website.

Customers under 18 must have permission from a parent or legal guardian to place an order.

We reserve the right to refuse orders for legitimate reasons, including suspected fraud, product unavailability or requests that may breach applicable laws.

2. Products and 3D Printing

Our products are manufactured using 3D-printing technology, and many are made to order.

Due to the nature of 3D printing, products may have:

  • Visible layer lines or minor surface imperfections.

  • Slight colour differences between filament batches.

  • Small variations in texture, finish or appearance.

  • Minor differences from product photographs due to lighting or screen settings.

These characteristics are normal where they are consistent with the product description and do not affect the product's acceptable quality, safety or intended function.

We aim to provide accurate product photographs, descriptions and measurements. All products remain subject to Australian Consumer Law guarantees.

3. Product Safety and Care

Some of our products contain small parts, moving joints or detachable components and may present choking or other hazards.

Customers should follow all product-specific warnings, age recommendations and care instructions.

Unless expressly stated otherwise:

  • Products containing small parts must be kept away from children under three years of age.

  • Adult supervision is recommended where appropriate.

  • Products should not be exposed to excessive heat, open flames or unnecessary force.

  • Damaged or broken products should no longer be used if they present a safety risk.

  • Products are not intended for food contact unless specifically identified as food-safe.

PLA and some other 3D-printing materials may soften or deform when exposed to high temperatures.

Our products must comply with applicable Australian product safety requirements. Warnings and care instructions do not override those requirements or customers' statutory rights.

4. Orders and Payments

All orders are subject to product availability, successful payment and acceptance by Coya's Creations.

Prices are displayed in Australian Dollars (AUD).

GST is included where applicable. Any delivery costs and optional charges will be disclosed before checkout.

We reserve the right to correct genuine pricing errors and contact customers if an order cannot be fulfilled as requested.

If an accepted order cannot be supplied, we will provide an appropriate alternative or refund in accordance with Australian Consumer Law.

Orders are processed through Shopify and its supported payment providers.

5. Custom and Personalised Orders

We offer personalised and made-to-order products, including custom names, colours, designs and accessories.

Customers are responsible for providing accurate customisation details.

Where a design preview or proof is provided, please carefully check all spelling, measurements and design details before approving production.

Once production has commenced, changes or cancellations may not be possible.

Custom and personalised orders are generally non-refundable for change of mind after production begins.

If we manufacture a product incorrectly or it does not meet Australian Consumer Law guarantees, customers remain entitled to an appropriate remedy.

We may decline custom orders involving designs that are unlawful or potentially infringe intellectual property rights.

6. Production, Shipping and Delivery

Many products are made to order, with a standard production target of up to 5 business days before dispatch, unless otherwise stated.

Custom, complex or larger orders may take longer.

Shipping costs and available delivery options are provided during checkout.

Delivery timeframes are estimates and may be affected by carrier delays or circumstances outside our control.

Customers are responsible for providing accurate delivery details.

If your order is lost, damaged or significantly delayed, please contact us so we can investigate and arrange an appropriate resolution.

We remain responsible for meeting our delivery obligations under Australian Consumer Law.

7. Returns, Refunds and Consumer Guarantees

All purchases are protected by Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law.

If a product has a major failure, customers may be entitled to choose a refund or replacement, or retain the product and seek compensation for its reduction in value.

For a minor failure, we may offer a repair, replacement or refund as permitted by law. Further remedies may apply if the problem is not resolved within a reasonable time.

We do not generally offer refunds or exchanges solely for:

  • Change of mind.

  • Incorrect personalisation details supplied or approved by the customer.

  • Choosing the wrong colour, size or design.

  • Normal, disclosed 3D-printing characteristics that do not make a product unacceptable.

These exclusions do not apply where a product fails to meet statutory consumer guarantees.

8. Intellectual Property and Licensed Designs

Our original branding, photographs, written content and designs are the intellectual property of Coya's Creations or their respective rights holders.

Some products are produced under commercial licences provided by independent designers. Purchasing a physical product does not transfer copyright or commercial reproduction rights.

Certain products may feature fan-inspired designs or references to established entertainment franchises.

Unless expressly stated and authorised, these products are independently produced and are not officially affiliated with, sponsored or endorsed by the relevant franchise owners.

Customers submitting designs for custom orders must have the necessary permissions to request their reproduction.

We reserve the right to decline designs that may infringe copyright, trademarks or other intellectual property rights.

9. Privacy and Customer Information

We respect our customers' privacy and take reasonable measures to protect personal information.

Information provided during checkout may be used to:

  • Process and fulfil orders.

  • Arrange payments and delivery.

  • Respond to enquiries.

  • Provide customer service.

  • Send marketing communications where permitted by Australian law.

Our website operates through Shopify, and relevant information may be processed by Shopify and other service providers, including providers located overseas.

We will not knowingly misrepresent customer feedback or publish misleading endorsements.

However, temporary interruptions, technical errors or maintenance may occasionally occur.

Our website may contain links to third-party services or websites, which operate under their own policies.

We are not responsible for independent third-party content or circumstances beyond our reasonable control, except where responsibility cannot lawfully be excluded.

Shopify provides our e-commerce platform, but purchases from our store are made directly with Coya's Creations.

12. Liability and Customer Responsibilities

Coya's Creations is committed to supplying products that are safe, accurately described and of acceptable quality.

Customers should use products according to their intended purpose and any relevant safety instructions.

We are not generally responsible for damage caused solely by abnormal use, deliberate misuse or alterations made after purchase where that conduct caused the damage.

To the extent permitted by law, we are not liable for losses caused by circumstances outside our reasonable control where we have not breached any applicable legal obligation.

Nothing in these Terms limits or excludes our obligations or your rights under Australian Consumer Law, including liability that cannot lawfully be excluded.

13. Changes to Terms and Governing Law

We may update these Terms to reflect changes to our products, business operations or legal requirements.

The latest version will be available on our website.

Updates will generally apply to future orders and website use. Existing accepted orders will remain subject to their agreed terms unless changes are lawfully agreed.

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth legislation.

If a dispute arises, we encourage customers to contact us first so we can attempt to resolve the matter fairly.

Customers retain their rights to seek assistance from NSW Fair Trading or other relevant consumer protection authorities and courts or tribunals.

If any provision of these Terms is unenforceable, the remaining provisions will continue to apply where legally possible.
